Delta Beverages has been dragged to court for contravening the Public Health Act after a Mbare man allegedly found condoms, grass and cockroaches in a sealed opaque beer container popularly known as "Scud".
Naison Mwendera (54) bought the Scud shortly after it had been delivered by a Delta Beverages truck at Vito Tavern. Mwendera immediately reported the matter to police leading to the subsequent dragging of the company to Mbare magistrates' court. Delta Beverages now faces a charge of selling unwholesome, diseased or contaminated article of food as defined in Section 69 (i) of the Public Health Act.
Mr Ephraim Tahwa, the brewery manager, is representing the company. Magistrate Mr Stanford Mambanje moved the hearing to February 26 after the trial failed to kick off on February 18. Appearing for the State, Ms Hilda Huni alleges that Delta Beverages manufactured, transmitted and exposed for sale a contaminated scud with two condoms, grass and cockroaches without adequate measures being put in place to guard against or prevent any infection or contamination. It is alleged that Mwendera bought the scud on December 26, last year in Mbare.
The State also alleges that he noted that the scud was contaminated when he drank his first sip and gulped the condom. Mwendere immediately reported the matter to the police, it is alleged. The scud is being held as evidence, while the State is expected to call the bar lady as a witness.
