A HIGH Court judge last week sent to jail a Nyajena man for six years after he and his assessors found him not guilty of murder, but guilty of culpable homicide of his young brother whom he stabbed with a knife.

Justice Charles Hungwe, sitting at the High Court on circuit, convicted Mavengano Dhamwe(33) of Dhamwe Village in Nyajena after he killed his young brother Prosper (30).

The judge said the court found that Mavengano had been provoked by his brother and was acting in self-defence.

Mavengano had through his lawyer Mr Phillip Shumba of Shumba and Mutendi submitted that the deceased had provoked him  by telling him that he did not belong to the Dhamwe clan as he had been fathered by another man.

He told the court that Prosper had dared Mavengano threatening to assault him for beating him when they were still young.
