A 35-year-old Rusape man quenched his sexual desires by raping his 10 year-old daughter infecting her with HIV/AIDS in the process has been jailed for 18 years.
Regional Magistrate, Mr Livingstone Chipadze, slapped the man (name withheld) with the lengthy jail term after he found him guilty of raping his daughter several times since January last year.
He had not pleaded guilty but the State led by Area Public Prosecutor, Mr Tirivanhu Mutyasira, provided overwhelming incriminating evidence that led to the conviction.
Mr Tirivanhu told the court that the crimes were committed from January to August last year.
"During this period the accused who had divorced his wife stayed alone with his 10 year-old daughter. They shared a one bed-roomed hut. On several occasions he used to remove his daughter's clothes and had sex with her.
"However, on December 28 last year the girl was taken to go and stay with the wife of the accused's brother. It was then discovered that the girl was not feeling well. She was taken to Rukweza clinic where nurses diagnosed that she had genital warts. They also tested for HIV/AIDS and found out that she was positive."
The nurses then questioned the girl and she revealed that she was raped by her father on numerous occasions.
The matter was reported to the police leading to the accused's arrest.
In his defence the father said the whole case was a fabrication being cooked up by his brother's wife whom he said they were not in good books. He said she was out to fix him, hence the rape allegations being leveled against him.
The accused agreed that he stayed alone with his daughter but insisted that he did not at any time have sex with the minor.
Mr Chipadza did not buy his case and he slapped him with a 18 year jail term.
Three years of the sentence were set aside on condition that he does not commit a similar offence in the next five years.
