Human rights lawyer Beatrice Mtetwa remained in police custody on Monday, more than 12 hours after a judge ordered her release, her lawyer said.
"She is still detained at Rhodesville police station," lawyer Harrison Nkomo told AFP, referring to a Harare law enforcement facility.
Mtetwa was arrested on Sunday while assisting aides of Prime Minister Morgan Tsvangirai during a police raid on their offices.
Police spokesperson Charity Charamba said Mtetwa was arrested for shouting at detectives.
Late on Sunday, Justice Charles Hungwe ordered Mtetwa's release.
Nkomo said the police's decision not to immediately heed that order was "a clear violation".
"The order was served on all the relevant authorities but she still remains in custody."
