Zimbabwe's Roy Bennett has lost his seat in the country's Senate and this means that he may not be sworn in as Deputy Agriculture Minister.
Bennett has been absent from the Senate for 21 consecutive meetings and according to the law, he has lost his seat.
Bennett returned to South Africa in October last year.
He said he was of better use to the Movement for Democratic Change campaigning in South Africa than behind bars in Zimbabwe.
President Robert Mugabe steadfastly refused to swear in Bennett as Deputy Agriculture Minister between 2009 and 2010.
Ministers are required to have a seat in the upper or lower houses of Parliament and after losing his seat, Bennett is not eligible to become minster.
