Woman fakes rape after being caught having sex with boyfriend

A 44-year-old Chipinge woman was left with egg in the face at the magistrate's court after her 27-year-old boyfriend, whom she was accusing of attempting to rape her, exposed their affair before her sons in a packed courtroom.
Vincent Ziyanduma had been hauled before Chipinge magistrate Mr Clemence Ngweshiwa last Thursday for attempted rape. He was, however, aqcuitted after the State withdrew charges as witnesses presented conflicting evidence.
Before the matter was taken to the criminal courts, it was brought before headman Samutsa's community court but the traditional leader washed his hands, like the biblical Pilate on Jesus' case.
Allegations were that on 4 August last year, Ziyanduma from Samutsa village in Chief Mutema's area followed Mangiza who was going to Samutsa from a nearby farm.
"Ziyanduma then sneaked into Mangiza's room and ordered her to take off her clothes but the complainant did not comply," reads the State outline.
Prosecutor Last Goredema said a determined Ziyanduma then tossed the woman to the ground and pulled her skirt up before he tried to remove her underwear.
"However, as they were tussling, the complainant's son Simon Mangiza who was on his way to the farm rescued her mother and a report was made to the headman who unfortunately failed to solve the matter," he said.
Interestingly, Mangiza's account of what transpired contradicts with that of her own son. Mangiza said she was still on her fet when her son arrived and also denied the fact that she was drunk when the incident occurred. She told the court that she stopped taking alcohol two years ago. But her son, Simon, said her mother was a seasoned guzzler and on the day in question she was drunk. He further said he found his mother already on the ground and Ziyanduma's pants where below knee level.
In his defence, the 27-year-old Ziyanduma told the court that he was madly in love with the 44-year-old Mangiza.
"Your Worship, we have been having sex together for years and at one time she spent the night in my hut. On several times I also gave her money and on the day in question she had begged me to escort her home from the farm and we were about to have sex when her son emerged from the blue," he said.
Magistrate Ngweshiwa said it was clear that the two knew each other romantically and on the day in question they were found by the son in a compromising position.
