Nixon 'Mao' Nyikadzino files a Constitution court poll date challenge case

A civil society activist Nixon 'Mao' Nyikadzino on Monday filed an application in the Constitutional Court seeking to compel President Robert Mugabe to proclaim an election date after complying with the constitutional requirements.

Nyikadzino argue that the holding of general elections by July 31 would violate his constitutionally-enshrined rights as a voter.

He said in complying with the order in the Mawire case, the respondents had a constitutional obligation not to infringe the law and constitutional rights of voters.

Mao went on to say there had not been progress in key and mandatory processes necessary for the holding of free and fair elections and Zec has not set up appropriate systems and mechanisms to eliminate election violence and other electoral malpractices.

He cited as respondents President Mugabe, PM Morgan Tsvangirai, Constitutional and Parliamentary Affairs minister Eric Matinenga, Justice and Legal Affairs minister Patrick Chinamasa, Registrar of Voters Tobaiwa Mudede and Finance minister Tendai Biti among others.
