The case in which Prime Minister Morgan Tsvangirai is seeking the extension of elections dates is being heard at the Constitutional Court in Harare.
In his heads of argument, Prime Minister Tsvangirai, represented by Advocate Uriri, is arguing that the Presidential Powers and Temporary Measures Act used to enact a Statutory Instrument 86:2013 is unconstitutional.
Statutory Instrument 86:2013 contained the proclamation of Nomination Court and election dates in compliance with the Constitutional Court ruling that provided that elections should be held not later than the 31st of July 2013.
Advocate Uriri was however advised to stick to the founding affidavit.
The court also advised Mr Tsvangirai that he was supposed to have made his application before the proclamation of election dates as already the electoral process is in full swing.
The court indicated that they have no power to interfere with that process.
