Mutumwa Mawere ordered to pay litigation costs

The Constitutional Court has ordered former presidential aspirant and businessman now turned MDC-T member, Mutumwa Mawere, to pay all the costs of the litigation matter in which he was seeking an extension of time within which to file his nomination papers.

Mawere has withdrawn his urgent chamber application heard before the full constitutional bench.

He cited the Zimbabwe Electoral Commission, the Registrar-General, the President of Zimbabwe and the Attorney-General as respondents.

Mawere was seeking relief to be granted by the court directing ZEC to reconstitute the presidential nomination court by Friday the 12th of July to allow him time to complete his pursuance of a national registration ID and for filing nomination papers by the 28th of June.

In opposing the application, the first respondent ZEC Chairperson Justice Rita Makarau cited the ruling in the application of Morgan Tsvangirai versus the President and six others which ordered that the election be held in terms of the proclamation issued by the President as having brought the matter to finality.

The Constitutional Court composed of nine judges, headed by the Chief Justice, ordered that Mawere bear the entire costs of the lawsuit at the highest scale.
