MDC-T election agents in court for conspiracy to commit fraud

Two MDC-T election agents yesterday appeared before magistrate Marehwanazvo Gofa facing charges of conspiracy to commit fraud.
The duo, Cosmas Kamba, 56, and Lancelot Mudavanhu, 59, pleaded not guilty to the charges that were allegedly committed during the July 31 harmonised elections.
On the day the alleged offence was committed, Kamba was a Ward 13 Harare West Constituency election agent while Mudavanhu was contesting in Ward 13.
The court heard that on the morning of July 31, Kamba while in possession of a Zimbabwe Electoral Commission official document form V11, proceeded to Haig Park polling station intending to hand over the documents to Manuel Madyara who was an MDC polling agent.
It is the State's case that Petronella Madzima who was commander of Haig Park collation centre confronted Kamba and recovered two envelopes that contained a V11 form, resulting in his arrest.
After being interviewed by the police, Kamba revealed that he had been given the forms by Mudavanhu.
Allegations are that Mudavanhu upon being arrested and subsequently interviewed indicated that he had been given the forms by the MDC National directorate but he did not disclose the name of the person who actually handed him the V11 forms.
In their defence, being led by Obey Shava, the duo deny the charges arguing that their possession of the documents was innocent and can be evidenced by them handing them over to the relevant authority.
Shava also argued that they did not conspire to commit any offence and handing over the document was sufficient to indicate that no misrepresentation was intended.
