The Constitutional Court today nullified the expulsion of Dr Munyaradzi Kereke from Parliament after his lawyers and those acting for Zanu-PF agreed on an out of court settlement, which allows him to remain the legislator for Bitkita West constituency.
The full bench of the Constitutional Court led by Chief Justice Godfrey Chidyausika granted the consent order penned by the parties' lawyers.
Dr Kereke had taken Zanu-PF to court for seeking his expulsion from Parliament on the basis that he had been fired from the party and could not purport to represent it in the August House.
This came after the National Assembly Speaker Jacob Mudenda advised Dr Kereke that he had ceased to be the legislator for Bikita West after Zanu-PF secretary for administration Dydmus Mutasa wrote to Parliament advising of Dr Kereke's expulsion from the party.
Dr Kereke challenged his expulsion from Parliament arguing that he had ceased to be a Zanu-PF member by the time he was elected on July 31.
