A magistrate told a 31-year-old Bulawayo man to stop touching his wife's mobile phone saying that was tantamount to invading her privacy.
Western Commonage magistrate Tancy Dube ruled in favour of a city nurse who was thoroughly beaten by her husband resulting in her losing a tooth.
Jane Nhongo, 28, of Old Pumula, was allegedly assaulted by her husband, Garikai Mushoriwa, after he discovered a missed call from a stranger in her cellphone.
Nhongo told the court that her husband also barred her from attending a church of her choice. In her affidavit, Nhongo alleged that her husband was in the habit of forcing her to remove her clothes whenever he intended to assault her. She also said Mushoriwa was no longer willing to share the bed with her.
"I have been married to Garikai Mushoriwa for four years and we have a three-year-old daughter. My husband is in the habit of physically abusing me and recently he assaulted me resulting in me losing a tooth," she said.
"He emotionally and verbally abuses me using offensive language and forcing me to sleep on the floor. Whenever he wants to assault me he first orders me to remove my clothes before flogging me naked."
However, in his defence, Mushoriwa argued: "We had some misunderstanding after I had discovered a missed call in her cellphone from a stranger and when I reprimanded her she became angry. I never forced her to sleep on the floor."
The magistrate confirmed the interim order and warned that if Mushoriwa breached the order he would be sent to jail.
