A security guard allegedly handcuffed his wife while forcing her to be intimate with him, the Harare Civil Court heard yesterday.
Revesai Chipfunde allegedly handcuffed his wife Paida Roki from the back and had sex with her without her consent.
Roki, who was seeking a protection order against Chipfunde, told magistrate Gamuchirai Siwardi that her husband forces her to have unprotected sex with her.
She told the court that Chipfunde tested HIV positive and she tested negative but he forces her to have unprotected sex or risk being handcuffed.
"He has two girlfriends who are HIV positive and I am negative," Roki said.
"He forces me to have unprotected sex and handcuffs me if I refuse in order to subdue me. He is also chasing me away from our house," she said before producing the pair of handcuffs before the court.
Roki also told the court that Chipfunde took the handcuffs from his workplace where he is a security guard.
Chipfunde strenuously denied his wife's allegations. He expressed shock at the production of the handcuffs, which he said did not belong to him.
"I have never forced her to have unprotected sex with me," argued Chipfunde.
"We usually go to Parirenyatwa Hospital for counselling where we are given condoms. She used to visit my workplace threatening me and later told his relatives that she no longer loves me.
"I do not know where she got those handcuffs from, they do not belong to me. Her relatives have barred me from visiting them and also threaten me with unspecified action."
Magistrate Siwardi ordered Chipfunde to stop abusing his wife in any way.
She said it is possible that Chipfunde is forcing the applicant to have sex with him.
"His actions are criminal and barbaric so the application for protection order is hereby granted."
