Kereke fights private prosecution

Bikita West legislator, Munyaradzi Kereke has  approached the Supreme Court to challenge a High Court ruling that ordered for his private prosecution in a case in which he is being accused of raping a relative in October 2010.

Prosecutor-general, Johannes Tomana has declined to prosecute Kereke on grounds of lack of evidence.

Kereke said Justice Zhou had mis directed in not finding that it was not every refusal by the prosecutor-general to prosecute the accused that should culminate in the grant of a certificate of 'nula prosequii'.

The minor's guardian, Francis Maramwidze, approached the High Court seeking relief so that his client may have access to justice after the prosecutor general had denied prosecuting.
