MDC-T Harare Ward 33 (Budiriro) councillor Sydney Chirombe was on Friday in court to answer to a sodomy charge for the second time this year after he was arrested in the Willowvale industrial area while allegedly having sex with another man in a car.
In March, Chirombe (49) appeared before a magistrate in Kariba facing a sodomy charge for allegedly assaulting a bus driver the Harare council had hired to transport councillors to a workshop in the resort town.
Magistrate Mr Sam Chitumwa acquitted Chirombe citing lack of evidence.
At the Harare Magistrates' Courts yesterday, Chirombe appeared before Mr Donald Ndirowei jointly charged with Joseph Muchena (23), the man he was allegedly caught in the act with.
The matter was remanded to Monday when prosecutor Ms Sharon Mashavira made an application to make inquiries at the Kariba Magistrates' Courts on how Chirombe's earlier case was handled.
In his bail application, Chirombe told the court that he was a proper candidate because he was of fixed abode and had a family. He will continue with his bail submissions on Monday.
Ms Mashavira alleged that at around 2:30am on May 15, a police patrol team in Glen Norah spotted a Toyota Noah (registration number ACH 7644) parked along Godwin Road in Willowvale.
She said the police officers found Chirombe sodomising Muchena on the front passenger seat.
Chirombe - in only his underwear - allegedly tried to start the vehicle and flee when he realised he had been caught.
However, one of the cops managed to grab the car keys and the pair was arrested, the court heard.
