A 63-YEAR-OLD Mangwe woman falsely accused her son of beating her up in a bid to have him jailed and get rid of him.

Angelina Mathe of Mambale Village told the court that she would rather have her son, Innocent Mathe (25), jailed than have him live with her at her homestead.

"Your Worship this boy has been mistreating me as if I am not his biological mother. He does not respect me at all yet he lives under my roof. He does as he pleases and I do not have control over him anymore.

"I would rather see him rot in prison than live in the same house with him. He has violent tendencies and I am afraid that some day he will hurt me because he is always threatening to beat me up if I do not do as he pleases," she said.

"We do not see eye to eye anymore and I do not want him in my house anymore. I would prefer it if he would remain in court rather than for him to come home with me because we cannot live under the same roof."

The court also heard that Innocent pulled down a fence surrounding his mother's homestead.

Innocent, who admitted to having destroyed the fence, denied hitting his mother.

"I did destroy my mother's fence and it was because she had angered me. I did not touch her or beat her up as she reported. These are all lies because I know that she wants to get rid of me.

"She has been continuously telling me that she wants me out of the house but that house is my home as well," he said.

The complainant falsely reported that her son had assaulted her in an argument over property which belonged to her. She told the court that her son punched her all over the body until she fled to a neighbour's house.

Prosecuting, Mr Stanley Chinyanganya said a misunderstanding arose between Innocent and his mother on 2 May over the issue of property.

Innocent's mother was complaining that her son was abusing her property. A misunderstanding arose and he assaulted the complainant with fists.

Innocent then pulled down a wire fence that was surrounding the homestead.

Plumtree magistrate Mr Livard Philemon sentenced Innocent to three months imprisonment which were suspended on condition that he performs 105 hours of community service at Mambale Primary School.

The assault charges were dropped due to lack of evidence.

Mr Philemon advised Innocent to make peace with his mother.
