$273 maintenance claim hits a brick wall

A Zimunya woman who was claiming maintenance from her ex-husband last week could not hide her disappointment after her $273 claim hit a brick wall when the Magistrate granted only $100.
Appearing before Mutare Magistrate Mr Langton Mukwengi, Lorraine Sanyangore was petitioning for maintenance from Daniel Magure on the grounds that he was no longer taking care of her and their three children after he just left their matrimonial home to live with another woman.
"He left our matrimonial home last year and since then he has left the responsibility of taking care of our children solely on my shoulders. He has every right to leave our home if he wants to, but he cannot run away from his duty as a father to take care of his children," said Sanyangore.
Magure, on the other hand, argued that his ex-wife's claim for maintenance was her way of punishing him after he ditched her because of her infidelity.
"This woman is only trying to fix me for leaving her. That is why she is claiming maintenance from me. I caught her red handed with another man and since then I have had nothing to do with her. However, I have been taking care of the children as a father should, but she cannot get enough. She still wants more money from me. I am only an electrician. I do not earn $1 200 as she is claiming," said Magure.
The magistrate later asked Magure how much he could afford and he offered $60, though he would not have wanted to pay any money if he had an option.
Said Magure:"I see no reason why I should pay any maintenance because I take good care of my children, but if she insists, I will give her $60 every month."
Mr Mukwengi, however, said $60 was too little for the upkeep of three children. In passing judgement, he finally settled for $100 which should be paid with effect from the 31st of this month.
