MDC-T councillor granted $100 bail in sodomy case

MDC-T councillor for Harare's Ward 33 (Budiriro), Sydney Chirombe, who was allegedly caught having sex with another man in a car, was yesterday granted $100 bail by the High Court.
Chirombe (49) and his alleged partner, Joseph Muchena (23), were freed on the same bail conditions.
Justice Esther Muremba ordered the two to surrender their travel documents with the Clerk of Court and warned them against interfering with investigations.
The pair will be back at the Harare Magistrates' Courts on July 1 for trial.
Bail was granted after defence lawyer Mr Shadreck Chisoko argued that the lower court had erred in rejecting their freedom bids.
Last month, magistrate Mr Milton Serima denied the pair bail because their alleged offence bordered on homosexuality, an act the highest office in the country - the President's Office - has described as being worse than the behaviour of pigs and dogs.
Mr Serima said that it was quite probable that since the accused were allegedly caught in the act, they could meet again after being released and repeat the "abominable act".
Chirombe's lawyer, Mr Chisoko, said the State's case was weak because a medical affidavit did not indicate anal penetration.
Allegations against the two arose on May 13 when a police patrol unit in Glen Norah approached a Toyota Noah (ACH 7644) parked on Godwin Road in Willowvale, and found Chirombe sodomising Muchena on the front passenger seat.
A half-naked Chirombe allegedly tried to flee, but was arrested.
In March, Chirombe appeared in court on similar charges after he allegedly sodomised a bus driver hired by the city council to transport councillors for a workshop to Kariba.
He was acquitted for lack of evidence.
