A HWANGE man accused of raping and impregnating a mentally-challenged and disabled woman after offering her R5 was yesterday jailed 10 years for the crime.
Desire Sibanda (24) of Lusambami village was found guilty by Hwange regional magistrate Dambudzo Malunga.
Prosecutor Tawanda Sigauke had told the court that on January 10 at around 9pm, Sibanda met the 32-year-old mentally-challenged woman at Jabulani beerhall.
He offered her R5 in exchange for sex and she agreed. He took her along Victoria Falls Road and stopped at the Truck Inn shops where he bought himself beer and biscuits for the woman.
Sibanda went to a nearby bush where he ordered the woman to remove her clothes, but she refused demanding that he pays the promised money first.
However, Sibanda pushed her to the ground and raped her once. After the rape an argument ensued again between the two with Sibanda refusing to pay as they returned to Truck Inn.
Their argument attracted onlookers and the woman revealed to them what had transpired, leading to Sibanda's arrest.
His lawyer Tonderai Charles Mukuku of Marongede, Mukuku, Ndove and Partners said his client was too drunk and did not know what he was doing.
But Malunga said what aggravated the offence was that Sibanda knew that the woman was mentally ill and that he impregnated her.
"The State does not oppose your defence and mitigation, but what I find undesirable is that you walked her more than 5km along Victoria Falls Road, raped and impregnated her knowing that she was mentally and physically handicapped," Malunga said.
Sibanda was handed a 12-year sentence and two years were suspended on condition of good behaviour.
