Chihuri, Tomana taken to court

TWO Chegutu residents who were recently acquitted on charges of robbing a local bank have taken Police Commissioner-General Augustine Chihuri, his subordinates and the Prosecutor-General (PG) Johannes Tomana to the Supreme Court in a bid to recover their vehicle and cash worth $16 000 which were seized four years ago.

Jotamu Gonese and Ackim Matare filed an urgent chamber application at the Supreme Court yesterday seeking an order to compel Chihuri and Tomana's offices to file a court application for condonation and have the matter finalised.

The pair, through their lawyer Charles Chinyama, cited the State, Chihuri, a Detective Assistant Inspector Madakuchelwa and Chief Superintendent Magwenzi as defendants.

The Supreme Court is yet to set down a hearing date for the pair's application.

According to the court papers, the police seized the cash and an Isuzu KB truck claiming the vehicle had been used in committing the crime.

Gonese and Matare had been implicated in the robbery that occurred in Chegutu in December 2010 where cash amounting to $266 000, R150 000 and 34 690 pula was stolen at gunpoint.

Following their acquittal, the State appealed against the court's decision, but the appeal was also dismissed by High Court judge Justice Nicholas Mathonsi in 2012.
