Former Zanu PF chairman Simon Khaya Moyo was complicit in the "illegal" holding of the party's December congress last year as he surrendered his powers to the then secretary for legal affairs Emmerson Mnangagwa.

Khaya Moyo after the congress was demoted to party spokesperson while Mnangagwa was elevated to first Vice President.

The Zanu PF spokesperson on Monday fired a salvo at ousted secretary for administration Didymus Mutasa who issued a statement last week dismissing the recent congress as illegally constituted.

Khaya Moyo also dismissed planned court action by Mutasa's group to nullify the congress.

Mutasa hit back saying Khaya Moyo literally handed over his powers to Mnangagwa.

"The disciplinary committee led us to this because the chairman (Khaya Moyo) was accepting everything that Mnangagwa suggested and that is criminal," said Mutasa.

"You do not subject people to a disciplinary committee where you do not ask appropriate questions and just say because it came from Mnangagwa then it is okay."

The statement by Mutasa could be an indicator of breaking of ranks between Khaya Moyo and a faction led by fired Vice President Joice Mujuru that also includes Mutasa and sacked spokesperson Rugare Gumbo.

Before the congress, Khaya Moyo belonged to Mujuru's camp but shifted allegiance following the former Vice President's dismissal from government among several cabinet ministers.
