Popular United Families International Church (Ufic) founder and leader, Emmanuel Makandiwa has not been threatened with litigation by a Harare man over failure to pay a $1 500 debt, contrary to last week's reports that he is being sued.
A graphic designer, Victor Chaita through his lawyer Norman Mugiya of Mugiya and Macharaga Law Firm, was reported to have threatened a local production company that allegedly has links with Ufic with summons unless the church settles a $1 500 debt.
It has since emerged that a Harare printing company, Eclipse Productions, based in Newlands, is the one which breached its contractual obligations of paying Chaita and not Ufic.
Chaita claimed to have done some design work for Ufic's 2014 magazine after being contracted by Eclipse Productions in which the two parties agreed the cost of work to be $1 500.
According to Chaita's lawyer, Mugiya, the graphic designer demanded his payment upon completion of the work but "you (Eclipse) gave endless and irrational excuses in order to avoid paying the due amount".
In the letter of demand, Mugiya accused the production company of reneging on the contract and instead used his client's design work to produce the church's 2014 magazine edition.
"We have been advised that you later pretended as if you did not link the graphic designer's work yet you (Eclipse) took the concept and decided to use it as yours and you are now selling our client's work as yours for the 2014 edition of the Ufic family magazine," wrote Mugiya.
Chaita, through Mugiya, threatened to take Eclipse to court unless he is paid the outstanding $1 500.
"We have been instructed to demand, as we hereby do, that you pay $1 500 through our offices, failure of which we will cause summons to be issued to you before further notice. Failure of that we will also demand that you pay 5% collection commission plus interest at the prescribed rate," wrote Mugiya.
Meanwhile, Makandiwa's spokesperson, Prime Kufa on Friday argued that Ufic never used the said concept and challenged Chaita or Eclipse to prove that the design that was used by the church in the edition belonged to the graphic designer who he claimed "has never had dealings with the church".
"We do not know him and have never dealt with him".
