Complainant humiliated by sex claims

A MAN accused of theft of trust property claims his incarceration was because he had ended his affair with the complainant.
David Mukwakwami, 24, added that while his former girlfriend, Verna Dzapasi, 24, had loaned him some money, she decided to lie that the money was for a business transaction and made a report saying that he had conned her "I deny that she gave me the money in trust for me to get a shop for her to rent She gave me the money as we were once lovers and I was supposed to pay it back.
"She decided to cook up these allegations because I ended the affair with her and she is bitter;" testified David
When Vema was called to the witness stand to testify,she revealed that she had given David US$300 for him to get her a shop for her beauty therapy business.
She also told the court that she had once stayed with David at the same house as co-ten- ants buthe betrayed the trust she had bestowed on him as he ended up duping her.
"Who told you that I'm an agent and I could get you a shop, you are lying to this court
"You gave me this money because we were lovers and I was supposed to pay you back.
"This US$300 you are talking of is it the only money you gave me?" quizzed David.
And Verna said saying that she had once given him US$10 through Ecocash for fuel
"You are telling this court that I was supposed to have provided you with the shop by the 1st of Match last year, but it's almost a year now, so why did you not promptly make a police report that I had conned you?" further argued David
"My husband told me that l had to be patient until a time I realised that you were not forthcoming and there was a time l had gone to Cape Town so I personally could not make follow ups," answered Verna.
But David was not yet done with the embarrassing chants, saying that the man Vema was claiming to be her husband was actually her boyfriend, who is married.
"Kunyepa here wakandisendera message uchiti waida kundifixer kuti ndaisa kupa mari apa ndaigara ndichikunyenga," revealed David.
And when he was asked to clarify what he meant by "kunyenga" David said "engaging in sex."
Verna then revealed that she had no idea why David was making all the embarrassing statements:
"I don't even know what wrong I did to you. You are making up all these lies and you are going to cause problems in my marriage."
But David was not yet done; as he went on to add that Venia would invite him to her house when her boyfriend was not around.

"Pese pandaiuya waiti ndipinde mubedroom wondipfekera kabum short kekhaki," revealed David.
Verna strongly opposed David's words saying "you are lying, I do not even have bum shorts and I never allow people into my bedroom because I have a very young baby."
David kept arguing that he had not received the money from Verna for him to get a shop.
And Verna also revealed that the alleged transaction had happened when it was just the two of them present, adding that she had just been shown the shop from a distance but had not gone inside.
Harare magistrate Batanai Madzingira ruled that without the essential elements of theft of trust property having been proven, David was to be discharged at the close of the State's case.
And he was FREED of any wrong doing.
