A Karoi villager has alleged that he was assaulted by former Zanu PF legislator Temba Mliswa's driver and when he reported that matter to the police he has continued to receive threats from the assailant and his colleagues.
The villager Kudzai Gasho said he was assaulted on 28 December 2014 by Mliswa's driver whose names are not stated until he was unconscious.
"The incident occurred in Karoi less than 8km from Mliswa's farm," said Gasho.
"A report was made to Karoi Police station that same night by a witness who took me to the hospital, two days later the investigating officer named Chingwe came to me with a view that l should withdraw my case (CR 131/12/14) against Mliswa's driver adding that the accused was from an untouchable family hence my case could not carry any value. I told the officer that my wish was that the case be heard in the courts of law."
Gasho said days became weeks and weeks became months nothing was done to the course of justice.
"Early January a new Investigating Officer on the case approached me and took my statement since on the day the case was reported. l was unconscious and a witness who was my good Samaritan had made the report," he said. "The officer again insisted that l withdrew that case on the basis that Mliswa is a high profile man, this was when l could clearly see that my case was being held because it involved a powerful family the Mliswas."
He said after some months he wrote a letter to the Officer in Charge Karoi urban.
The letter he wrote reads, "I reported a case of assault against the accused on CR 131/12/14 in Dec 2014 I was assaulted and rendered unconscious by the accuse," he said. "I'm now concerned that since December 2014, the accused has never been arrested and is walking free. Despite numerous visits to the police l am not getting positive feedback on the current position of my case. May you kindly assist through your office to ensure that justice is done? It is commonly accepted that justice delayed is justice denied."
"He also made it clear to me that even if l report my case in Harare it would still come back to him and no officer at his station can take action without his command," he said. "l called my relative who is a Chief Superintendent in one of the provinces to assist me on this case, immediately he called Chief Supt Mandizha who is head of Karoi district, he told me that he had spoken to Mandizha and assures me that Mandizha or his assistant supt Majogo were going to call me in connection with that case. Assistant Chief Sup Majogo called me later that day and said he was going to make a follow up on the case.
Nothing again was fruitful to my efforts, except that a docket was pulled and police from PISI department called me to tell me that l was on the list of wanted persons."
He said he asked which case and was told in 2012 a report was made against you of domestic violence and that lm a wanted person.
" l told the officer on the phone that l had been in court 3 times in connection with that case and the court had told me that they will notify me by way of summons when lm needed since the complainant was not coming on trial dates to court" he said. "Then the police officer told me that the court record that shows you once went to court was missing and therefore you are on wanted person's list. Complete human victimization all in a bid to protect Mliswas driver who l hear is also related to Temba."
He said Karoi is his home town but he is no longer safe.
"I now know that for as long as l don't withdraw my case lm not safe.," he said.
"But l believe in the truth Zimbabwe should observe laws My voice should be heard. Now l am thinking of going to Zambia since in my own land lm being victimized because lm trying to exercise my constitutional rights to have my case heard in the courts of Zimbabwe," he said.
