HAVING endured incessant assaults and harassment from his workmate, a Dangamvura kombi driver approached the courts praying for a protection order against him.
Never Dhliwayo popularly known as 'Scotch' told the court that he had known no peace with his workmate who was in the habit of assaulting him alleging that he was having an affair with his wife.
"My Worship, I have had enough of his assaults and I am now living in fear of him since he is now threatening me with death hence I am praying for a protection order against him," Dhliwayo told the court.
The court heard that on April 8, Brighton Mutongoona met Dhliwayo at a bus stop and suddenly switched off his vehicle. He dragged him out of the vehicle and attacked him with stones alleging that he was having an affair with his wife. This resulted in Dhliwayo sustaining head injuries and was taken to hospital for treatment.
"I can show the court the three stitches on my back as a result of that incident. I know his wife because I used to ferry her goods to and from town since she is a vendor.
"The other day, I saw a missed call on my phone which was from Mutongoona's wife and I responded with a please call me back. Little did I know that it was a set up. He approached me claiming that I was still communicating with his wife. He started assaulting me and threatened to stone my vehicle. As if this was not enough, he approached my boss and told him that I was having an affair with his wife . This resulted in me being suspended from work," explained Dhliwayo.
In response to the allegations, Mutongoona admitted to assaulting Dhliwayo over having an affair with his wife.
"Everything he said is true. I assaulted him after he continued having an affair with my wife after several warnings for him to stop seeing her.
I came to know about the affair through my workmates and my neighbours since they were using his vehicle as their bedroom. When I warned him he said that I had to talk to my wife and he left me with no option, but to use other means to stop this relationship. And now he cannot admit before this court because this is clearly an offence," claimed Mutongoona.
Mutongoona further stated that he later discovered some messages sent to his wife by Dhliwayo, asking about her whereabouts and when confronted him, he claimed that he wanted to ask money from Mutongoona's wife to clear up his hospital bills.
"Since he could not stop dating my wife I decided to take the matter to his boss," argued Mutongoona.
However, the presiding magistrate, Mrs Yeukai Chigodora, granted the protection order and advised Mutongoona to take legal action against Dhliwayo for adultery.
