A MUTASA man who was last year convicted for circumcising his two children with a nail cutter was last week sentenced to four months in jail for assaulting them.
Peter Nyashega (33) was convicted on his own plea of guilty by senior Mutare magistrate Mrs Sekai Chiundura when he admitted to have assaulted his children with the intention of causing body harm.
Prosecuting, Mr Shepard Chavarika told the court that Nyashega who was convicted last year for physically abusing the children lost custody of them to his brother, Patrick Nyashega while he performed community service.
"After performing his community service in Huana, Nyashega went and forcibly took the children from his brother. He took them home. On April 10, Nyashega assaulted his older son, Tinashe Nyashega, now five with open hands and fists.
"He sustained a swollen face and bruises," said Mrs Chavarika.
In his defence, Nyashega said he saw nothing wrong in him disciplining his children when they misbehave.
"It is our culture to discipline our children when they misbehave. These are my children and I have to beat them when they misbehave. I admit I over did it, but I am justified because my father did the same to me during my childhood
"Even when I circumcised them with a nail-cutter, I was acting according to our culture as I was also circumcised using the same method Your Worship," said Nyashega.
Mrs Chiundura described Nyashega as a bad father who did not deserve to stay with his children as he was abusing them.
"I think these children will be better off without you. You circumcised them with a nail-cutter. After that you also assaulted them after being convicted, so you are a bad father. So I am sending you to jail so that you will come back a good father," said Mrs Chiundura
He was sentenced to effective four months imprisonment.
