The Labour Court will on Tuesday preside over the labour matter pitting sacked former Zimbabwe national cricket team coach Phillip Simmons and Zimbabwe Cricket, where he is seeking to be paid more than $300 000 in unpaid salaries and damages for unlawful termination of contract.

Simmons, who is now playing for Ireland's national cricket team, parted ways with Zimbabwe Cricket on the 27th of January 2006 having coached the Chevrons since the 1st of September 2004.

He instituted proceedings at the High Court on the 19th of June 2009 represented by Jonathan Samukange and the matter was referred to the Labour Court in 2011.

In his current application, Simmons seeks condonation from the court on the basis that due to his placement in Ireland, communication with his legal practitioners has not been smooth.

He argues that Zimbabwe Cricket concedes that it unlawfully terminated his contract as evidenced by an effort by Manase and Manase Legal Practitioners to pay him $60 000 as full and final settlement.

He begs the court to order Zimbabwe Cricket to pay him $330 000 broken down as $195 000 in damages, plus $75 000 for 6 months' notice and $50 000 for unpaid salaries for 4 months, plus interest at the prescribed rate to date of full and final payment.
