Brothers attack neighbour

A BOUNDARY dispute saw an Odzi man dragging his neighbours to court seeking a protection order.
Simbarashe Chinyoni and his neighbours, the three Chari brothers - Blessed, Takesure and Emmanuel appeared at Mutare Civil Court before Mrs Annah Ndiraya who granted the protection order which bars the brothers from assaulting Chinyoni or visit his homestead.
The court heard on May 22, the three brothers were spotted cutting down trees for firewood in Chinyoni's field.
This did not go down well with Chinyoni who retaliated by attacking them with a catapult. The three brothers ganged up and assaulted him.
"This all started when I found them cutting down trees in my field and my attempt to stop them resulted in this grudge. They have been visiting my homestead attempting to assault me and my family is living in fear because of their endless threats.
"This has turned into a family feud, yet it was a simple thing that needed to be discussed. I pray that the court will grant the protection order," said Chinyoni.
The first respondent, Blessed admitted to have attacked Chinyoni, but said it was in retaliation after he (Chinyoni) was the aggressor.
"We admit assaulting and threatening him, but it was in retaliation to his attack on us. We were cutting firewood in a hill near his fields and we did not trespass into his property as he is claiming. He is also claiming ownership of the hill.
"He even struck one of my brothers whose name is not on this court application, but he is in court today. He was admitted at Mutare Provincial Hospital and a police report was made, therefore this application for a protection order against us is a fuss since he is the one who has been giving us trouble," said Blessed.
The other brothers agreed with Blessed's submissions.
