Man to pay R19,000 maintenance

A CHIPINGE man, who dodged paying maintenance for his two children for five years, has been ordered to pay R19 200 in arrears.
Sam Myambo (44) of House Number 1931 Gaza O, Chipinge was on Monday hauled before Chipinge magistrate, Mr Noah Gwatidzo, facing charges of contravening section 23(1) of the Maintenance Act Chapter 5: 09.
He pleaded guilty to the charge.
Mr Gwatidzo advised him to clear all the arrears.
He was slapped with a three-month jail term which was wholly suspended on condition that he pays the arrears before July 31 or risk imprisonment. Public Prosecutor, Mrs Edith Phiri told the court that on April 30, 2009, the accused was ordered by a Chipinge court to pay the sum of R 300 per month in respect of his two minor children.
"The accused person then failed to pay maintenance from the month of June 2010 to April 2015 and his arrears amounted to R19 200," said Mrs Phiri.
Asked why he was not paying the money, Myambo said he was no longer paying through the court process but was handling the money direct to the complainant, Esther Ndumeya (38).
"Your worship, I was no longer paying through the court since the complainant said it was taking her too long to get the money through the court process. She would come to collect the money at my workplace," he said.
He also mentioned that he last paid for maintenance three months ago and gave her an amount of $110.
"I did not default willingly but this was due to unemployment, therefore I pray before this honourable court to assist me in creating a reunion with my wife so that she can come and stay with me, because this is now tough to me since I am not employed," he said.
