Temba Mliswa want Zanu-PF's Guzah to be recalled

Losing candidate for the Hurungwe West constituency Temba Mliswa's electoral court petition has commenced before Justice Chinembiri Bhunu.

Mliswa is seeking the removal of incumbent legislator Keith Guzah citing several damning allegations.

In his affidavit, Mliswa contends that Guzah used to go by the name Never Phiri and was convicted for car theft and sentenced to a term of imprisonment making him ineligible from holding the office of Member of Parliament.

He accuses Guzah of committing electoral fraud as he was not registered in Hurungwe West and seeks his disqualification from parliament.

He additionally accuses him of wide spread acts of intimidation and meting out violence to the people of Hurungwe West constituency ahead of the polls.

Mliswa further contends that Guzah politicised traditional leaders and co-opted them as election agents and of vote buying, thereby corrupting the electoral environment leading to an undue return.

In response, Guzah accuses the petitioner of abuse of electoral procedure and ridicules the application for lacking merit on the basis that the application is premised on defamatory allegations and seeks its dismissal with costs on a higher scale.

He says after his nomination as candidate for the Hurungwe West by-election on the 8th of April, his failure to vote was due to a technical error on the part of the Zimbabwe Electoral Commission which was publicly acknowledged by ZEC Chairperson Justice Rita Makarau.

He adds that he never used the name Never Phiri in his life nor was he ever convicted for car theft in 1999 and he challenges Mliswa to prove the serious accusation.

Guzah says Mliswa has no legal basis for alleging that he stole the parliamentary by-elections through fraud, bribery intimidation and undue influence but he is merely disappointed by his loss in the face of his expectations of victory.
