Soldiers jailed for rape

Two Zimbabwe National Army soldiers based at 4.2 Infantry Battalion in Gutu, were on Friday jailed for raping a 16-year-old girl while the other stood guard.

Takudzwa Gwai (22) denied rape charges while his friend Tatenda Machaka (23) denied attempted rape when they appeared before regional magistrate Mrs Estere Chivasa.

Mrs Chivasa convicted the pair and sentenced Gwai to 15 years and suspended three years for five years.

He will serve and effective 12 years.

Machaka was slapped with a 10-year jail term, but three years were suspended for five years.

He will serve an effective seven years. The court heard that Machaka had tried to rape the same girl, but failed.

In passing sentence Mrs Chivasa said although Machaka who is HIV positive, did not penetrate the girl his behaviour was risky to her life.

The prosecutor Mrs Karen Kunaka said the soldiers and the teenage girl were neighbours.

Allegations are that Machaka and Gwai visited the girl's house on July 27 at around 8pm and found her outside the house.

They allegedly asked her to follow them and she complied and they went to Gwai's house where Machaka locked her up in the bedroom.

The court heard that Machaka started seducing the girl while Gwai remained outside.

He allegedly undressed the girl and tried to be intimate with her and the girl wrestled with him until he unlocked the door and went outside.

It is alleged Machaka locked the girl in the bedroom as he left and then Gwai entered the house and raped her.

She reported the abuse to her brother who in turn alerted their parents.
