Rape suspect demands sentence before plea

THERE was drama at the Mutare Magistrates' Courts after a rape suspect demanded his sentence from the presiding magistrate stating that he did not want to waste his time in remand but wanted to start serving so that he gets out of jail early.

Tonderai Chisero (24) of Chief Chisero in Buhera was not asked to plead when he appeared before Miss Nyasha Kuture facing rape charges.

He was remanded to 24 September 2015.

It was after Chisero had been advised to apply for bail at the High Court that he demanded to be sentenced immediately saying he indeed raped the complainant.

"Will you just sentence me today so that I start serving my term because if you keep on remanding me, when you finally sentence me you will not subtract the time that you would have kept me at the Remand Prison before conviction," he said.

"I do not see the reason why I have to be given another date and change courts, when I am pleading guilty.

"I did rape the girl so please sentence me," he said much to the court's amazement. Prosecuting was Mr Donald Mudadirwa.

Circumstances surrounding the matter were that Chisero allegedly raped a 12 -year-old minor in a bushy area along the Save River in Buhera. Miss Kuture told Chisero that her court had no jurisdiction to sentence him.

"This court does not have jurisdiction to give you bail, a sentence or even to try you but the High Court does which is why I am advising you to make a bail application at the High Court," advised Miss Kuture.
