You are not above the law, Tomana told

After failing to comply with court orders for him to issue certificates of private prosecution in rape case against Zanu-PF Bikita West MP Munyaradzi Kereke, the Zimbabwe Lawyers for Human Rights said that Prosecutor-General Johannes Tomana is not above the law.

This comes after the girls guardian Francis Maramwidze successfully applied for Tomana to issue a certificate for Kereke to be prosecuted privately.

Tomana was also ordered by the court to issue a certificate for the private prosecution of Jane Mutasa, in allegations that she defrauded Telecel Zimbabwe (Private) Limited of $1.7m in an airtime scam.

Following the court orders, Tomana filed a Constitutional Court application, arguing that he was the only person with the discretion to issue a certificate for private prosecution.
