A Harare man allegedly defied a court order compelling him to pay maintenance for the upkeep of his three minor children and his wife, resulting in him accumulating $34 415 in arrears.
Hubert Fungai Nyambuya (45) of 7 Gaydon Road, Greystone Park in Harare, yesterday appeared before magistrate Mr Tendai Mahwe charged with four counts of "failure to pay maintenance".
He pleaded not guilty to the charges and was remanded out of custody to November 19 for commencement of trial.
The complainant is Nyarai Bakasa of 14 Woodward Road, Marlborough in Harare.
Prosecutor Ms Samantha Dhlamini alleged that on December 28 2012, Nyambuya was ordered by the High Court to pay $150 every week for groceries and daily needs of their three minor children.
The court heard that from December 2012 to date, Nyambuya did not comply with the High Court order and accrued maintenance arrears of $7 568.
It was further alleged that on December 30 2012, Nyambuya was dragged to Harare Civil Court by Bakasa and was ordered to pay $500 maintenance for her.
Nyambuya was also supposed to pay tuition fees to the university that Bakasa was attending, but he reportedly breached the order and is in arrears of $16 480, the court heard.
On July 9 2013, Nyambuya was also ordered by the High Court to settle outstanding school fees of $1 410 for his son who attended school at St George's Hartmann House.
Nyambuya's arrears accumulated to $6 307 after he reportedly failed to pay the fees.
The court heard that on January 29 this year, the High Court ordered Nyambuya to pay $200 per month for the upkeep of his two minor children.
However, according to State papers Nyambuya has not been paying the money and is in arrears of $3 700.
