UK-based woman wants to divorce 'patriotic' husband

A UNITED Kingdom (UK) based woman has filed for divorce against her "stubborn" and "patriotic" husband who is allegedly refusing to leave the country and join her in the Diaspora.

The couple has not lived together in their barely six month marriage.

The couple tied the knot under Chapter 5:11 of the Marriages Act at Western Commonage magistrate's court on September 22, 2015.

Sikholisile Moyo last week filed summons at the Bulawayo High Court against her husband Godfrey Dzoro.

Moyo said the marriage between the two parties has disintegrated to an extent that it could not be salvaged.

"The marriage between the parties has irretrievably broken down and there are no prospects of restoration of a natural relationship because we've been staying apart since our marriage. The defendant lives in Harare while I'm in the UK."

In court papers, Moyo claimed that her husband "deserted" her by virtue of his refusal to join her in the UK.

"The defendant has deserted me because he has failed to take residence with me in the UK after the marriage," she said.

Moyo, through her lawyers, Phulu and Ncube Legal Practitioners, seeks the court to entertain her matter in terms of section 3(1) (a) of the Matrimonial Causes Act.

Moyo said she has lost affection and love for Dzoro and wants a divorce order granted in her favour, arguing that they were now incompatible.

The couple does not have a child together and there are no assets which were acquired during the subsistence of the marriage.

Dzoro has up to April 19 to respond.
