Hostile victim defends sex abuser in court

A girl, 12, from Entumbane suburb turned into a hostile witness yesterday after she took to the stand and aggressively defended her cousin, 22, who had sex with her.
The girl, whose name cannot be disclosed for legal reasons, alleged that she told Prosper Mkhothamo that she was 16 years old before they had consensual sex.
Mkhothamo is being charged with having sex with a minor, but the girl said he did not have a case to answer.
"I told my boyfriend that I was 16 years old and there's no reason whatsoever to crucify him for any crime," said the girl.
According to the prosecutor, Mufaro Mageza, the minor had initially refused to testify against Mkhothamo before Western Commonage magistrate Themba Chimiso.
Prosecutors then recommended that she be taken for counselling as she was being hostile.
The magistrate agreed and referred her for counselling after he stood down the matter.
Mkhothamo was remanded in custody.
The court heard that the matter came to light after the girl's aunt noticed some blood stains on her undergarment on the day she allegedly had sex with Mkhothamo.
The two had allegedly been in love since November last year.
"On March 19 of this year at around 8PM the accused person visited the complainant at her home where she was alone. The accused requested to engage in sex with her and she accepted," said Mageza.
The matter came to light when blood stains were discovered on the girl's pant.
"The aunt interviewed the girl and she revealed the incident. Complainant was referred to hospital for examination and a medical report can be produced as an exhibit," said Mageza.
