Is Prof Mutambara right: High Court asked

THE High Court of Zimbabwe sitting in Bulawayo was asked by a renowned advocate whether or not it is right for Professor Arthur Oliver Guseni Mutambara to continue creating chaos in the inclusive government.
Making submissions during the hearing of an application for the confirmation of an interim relief barring Prof Mutambara from masquerading as the MDC leader, renowned advocate Adrian De-Bourbone representing the Prof Ncube led MDC asked Justice Lawrence Kamocha whether or not Prof Mutambara's acting were in order.
He asked rhetorically: "Is it right for the Courts to create chaos in the Global Political Agreement pending a determination by the High Court of Harare? No the advocate said.
"Is it right that 13 disgruntled formers of a political party in this case the MDC, should prevent the party from functioning against the will of more than 4000 who voted for the party leader in the congress? No – the advocate said.
"Is it right that Mutambara must claim leader ship of a political party in which he chose not to run in its elective congress? No, again said the advocate.
Adv. De-Bourbone further argued that the High Court of Bulawayo must seize itself with the matter at hand and not be disturbed and or lured to discuss the matter pending in the Harare High Court.
The power wrangle between Prof Mutambara and P rof Ncube over the leadership of the MDC started soon after the 7-9 January 2011, in which Prof Mutambara was not nominated and also chose not to contest the elections.
After that, Prof Mutambara and other 13 members of the MDC, approached the High Court of Harare seeking an order nullifying the Congress results arguing that procedures at the congress were not properly followed. The matter is yet to be concluded.
Thereafter, Prof Ncube dragged Prof Mutambara to the High Court of Bulawayo on an urgent basis seeking an order barring Prof Mutambara from masquerading as the leader of MDC.
The order was granted on an interim basis and is yet to be confirmed. If confirmed Prof Mutambara will have to exit the office of the Deputy Prime Minister of the Republic of Zimbabwe and make way for his nemesis – Prof Ncube.
The matter was postponed indefinitely.
