'Rapist teacher' free after police bungling

A Gororo Primary school teacher who allegedly raped a 13 year old Grade 7 pupil from the same school has the Police to thank for his freedom as he was freed on technicality cited by his legal representative recently at the Chivi Magistrate Court.

Taurai Wamambo (30) a primary school teacher at Gororo under headman Makore was freed by Magistrate Bishard Chineka after his lawyer Cossam Chuma  of Chuma Gurajena Legal Practitioners cited Section 50 Subsection 3 of the Constitution which prohibits the Police from detaining a suspect for more that 48 hours without going to court.

According to the State led by Nixon Chamisa, Wamambo was arrested on July 22 for allegedly raping a pupil but was only brought to court on July 29 after exceeding the mandatory 48 hours a suspect has to be kept in Police custody.

"Any person who is not brought to court within forty-eight hour period referred to in subsection (2) must be released immediately …" reads part of the section.

His lawyer Chuma cited the anomaly which the Magistrate took into consideration and freed the suspect. The State will only proceed by way of summons.

It is the State case that on June 24 Wamambo ordered the complainant to accompany him to the fields in the village and when they were at a secluded place he is alleged to have forced the Grade 7 pupil to remove her undergarments.

The complainant refused upon which he forcibly removed her pant and had sex with her without her consent. The act resulted in her clothes getting soiled and when she got home she narrated the events to her parents and eventually reported the matter to the Police leading to the arrest of the teacher.
