Man escapes jail for fondling married woman

A 33-YEAR-OLD man from Epworth escaped jail by a whisker after he was convicted of fondling a married woman's breast. Smart Chigodera had pleaded not guilty to allegations of indecent assault but was convicted after a full trial before Harare magistrate Audrey Tarugarira Robertson. He walked out of court a happy man after he was warned, cautioned and discharged.
The State told the court that on October 3 the complainant, Stembeni Nyamhunga, had an altercation with Chigodera's wife, accusing her of facilitating an extra-marital affair for her husband. The altercation turned nasty and Chigodera reportedly went to stop the argument and in the process landed his hand on Nyamhunga's left breast.
This did not go down well with Nyamhunga who rushed and made a police report leading to Chigodera's arrest. It seems Smart was not so smart in his mediation efforts by landing his hand on the valuables of the woman thereby earning himself a brush with the law.
Before the court Chigodera had denied fondling the woman out of will saying he was only playing the mediation role. After his conviction, Chigodera prayed for a lighter sentence. State counsel Crispen Mavengano appeared for the State.
