Higher Education minister Jonathan Moyo has vowed never to submit himself to Zimbabwe Anti-Corruption Commission (Zacc) for questioning.
He said anti-corruption unit member Goodson Nguni is biased.
"I will not submit myself to any Zacc investigation, whose investigation committee is headed by Goodson Nguni, who has proven beyond any reasonable doubt that his committee is no better than a kangaroo outfit pursuing a factional agenda," he wrote Cabinet Secretary Misheck Sibanda.
He added "I am prepared and ready to assert this right by taking the matter to the Constitutional Court".
Moyo is accused of benefitting from close to $270 000 which was corruptly syphoned out of Zimdef by ministry and fund official.
Part of the money was used to procure bicycles for chiefs in Tsholotsho.
At the weekend Moyo admitted to embezzling the funds but said he channelled them towards a national event.
