A junior member of the police walked out of court a happy man after being acquitted of assaulting his superior's husband.
Job Mapfumo emerged a victor when he appeared before Mbare magistrate Gladys Moyo charged with assault.
Mapfumo had been taken to court for assaulting Luke Muzembe who is husband to a superior officer in the police force after he was being accused of maintenance default.
In her ruling magistrate Moyo cited inconsistencies in the evidence of both the complainant and other witnesses.
Previously Mapfumo had also hauled Muzembe to court facing similar charges on which he was acquitted after a full trial.
Circumstances leading to Mapfumo being taken to court are that on August 30 this at around 11pm he went to the complainant's place of residence in the company of other police officers intending to arrest Muzembe for maintenance default.
The court heard that the complainant told Mapfumo that he was not aware of the arrears that warranted an arrest and requested to be taken to the officer-in-charge for clarification.
Mapfumo is said to have refused and took out his handcuffs and arrested the complainant but pressed the cuffs tightly.
The court also heard that Mapfumo dragged the complainant on the stairs from the first floor to the ground.
It is said Mapfumo continued to assault the complainant who was handcuffed by striking him with open hands several times and pressed the cuffs tighter.
When they got to Machipisa, Mapfumo forcibly pulled the complainant making him to fall on the ground.
The complainant made a report leading to Mapfumo's arrest.
