Late woman's daughter challenge eviction from mother's property

The daughter of a late woman has challenged an eviction from her mother's property by an Estate Executor.

Annarieta Shumba being the eldest daughter of the late Beatrice Hove filed an application at the Bulawayo High Court on October 13 challenging their eviction from the late mother's property by the Estate executor Barbra Lunga.

In her founding affidavit Shumba said she was applying for the dismissal of a case number HC 3431/15 for want for prosecution.

"On December 21 2015 the respondent instituted application proceedings wherein she was claiming inter alia a declaration to the effect that house number 514 Nkulumane township be part of the Estate of the Late Max Hove and the eviction of all those claiming occupation to the same property," reads the affidavit.

She said she filed a response to that application.

"On February 26 2016, the respondent filed an answering affidavit and to date she has not filed heads of argument. The applicant has failed to prosecute her matter to finality. It is more than six months since the respondent filed her answering affidavit."

She prayed for Lunga's application to be dismissed.
