Zaka teacher gets 3 years for sex with a pupil

A Zaka teacher was last Friday lucky to survive a lengthy jail sentence after Regional Magistrate Judith Zuyu convicted him on a lesser charge other than rape and gave him a 3 year sentence.
Steward Makoni of Mutonhori High School appeared before Magistrate Zuyu facing rape charges but was convicted on a lesser charge of sleeping with a minor.
The State led by Liberty Hove told the court during trial which started last Monday that sometime in February this year Makoni who was a teacher at Mutonhori in Zaka had sex with a 15 year old Form 2 pupil on several occasions.
The matter came to light after the minor's brother realised that her sister was now in the habit of buying expensive food at lunch and became suspicious.
He also realised that she was now having a cell-phone which he knew their parents would not afford.
The matter was reported and investigations led to the arrest of Makoni after the minor said she was forced to sleep with him.
In giving judgement magistrate Zuyu said according to the evidence produced by both parties in court it was obvious that Makoni did not force the minor into sex but the two agreed.
She convicted him on a lesser charge of sleeping with a minor and sentenced him to 3 years of which one year was suspended leaving him to serve an effective two years imprisonment.
