An estranged wife - Sifiso Hungwe tried to force her husband into having sex with her with the intention of later reporting that he raped her, a court heard.
Hungwe said her hubby; Bongani Nyathi should divorce her in a proper way.
"I have been married to Bongani Nyathi since 2004.
"We have two children together. Bongani is in the habit of chasing me out of the house saying he is no longer interested in me.
"He is also threatening to kill me if I refuse to take head of his eviction orders.
"My prayer is that if he no longer wants me as his wife she should follow the right procedure rather than chucking me out of the house because by doing so he is disturbing my peace".
However, tables turned when Nyathi gave his version.
"All that she said is not true. I am not a violent person.
I have never threatened her with death in any way. She is the one who is abusing me. She is always stalking me and provoking me".
"She is always coming home drunk and forcing me to have sexual intercourse with her, so that after the act she can report me to the police for marital rape.
"The reason why she wants to have me arrested is that she wants to take over my house upon condemnation to prison.
"We are sleeping in separate bedrooms and I am surprised with her claims that I am chucking her out of the house yet she is the one using the main bedroom"
Magistrate, Tawanda Muchemwa dismissed Hungwe's application saying she did not dispute her husband's claims that she was the one who was abusing him.
