A man who caught his wife having sex with a local villager and gave her a thorough beating escaped a jail term after the cheating wife told the court that they had settled their differences.
Ndabezinhle Juba (32) of Jongela village pleaded guilty to a domestic violence charge when he appeared before Nkayi magistrate Ndumo Masuku. The magistrate convicted Juba but later warned, cautioned and discharged him after the cheating wife Simiso Sibanda (25) admitted that she had provoked her husband. She also told the court that her husband had forgiven and accepted her back into their matrimonial home despite the fact that she had sinned against him.
The prosecutor, Maxwell Hapanyengwi told the court that on July 23 last year, Juba found his wife being intimate with Thabiso Gabu, a local villager in a bush near a borehole. When the two saw him, they fled in different directions.
Later in the evening at their matrimonial home, Juba attacked his wife with clinched fists and a stick several times. Sibanda ran away from the home and later made a report to the police leading to Juba's arrest.
In mitigation, Juba asked the court to be lenient with him since he had forgiven his wife for the wrong she had done to him. The wife also asked the court to drop the case saying her husband had forgiven her even though she had seriously wronged him. She said since Juba was the family's breadwinner, it would be difficult for the family to survive if he was incarcerated.
