A Zhombe thief who is battling for his life at Kwekwe General Hospital after he was struck in the head with an axe by his victim was Wednesday let off the hook owing to poor health

Darlington Baloyi (25) has been in hospital over the past month nursing a head injury sustained during the night of March 7 when he attempted to break into the house of Gomola Primary School headmaster Michael Bejana.

Baloyi, who was in the company of Zamile Sitsha and Clement Muzilami (still at large), used an axe to break into the headmaster's house while he was asleep inside.

According to the State, after breaking the door, Baloyi was struck with an axe in the head as he entered the house, sustaining a deep cut.

His accomplices then fled the scene leaving Baloyi in the hands of his victim who immediately reported the matter to the police.

Baloyi and his gang had robbed two other houses of property worth $50 before running out of luck and the property was recovered after Baloyi's arrest.

After being remanded in hospital under prison guard as he battled for his life, the State on Wednesday withdrew charges before plea to allow the accused time to recover from his head injuries.

Area prosecutor Brian Mzemba told the court that Baloyi had not benefited from the crime and had already suffered immensely from the life-threatening wounds.

"This action by the State will allow accused to seek medical attention even at private hospitals without having to seek clearance from the courts or prisons," Mzemba said.

Provincial magistrate Taurai Manwere presided over the matter at Kwekwe General Hospital.
