Man rapes, impregnates deaf and mute minor

A 35-YEAR-OLD man from Mpofu Village in Lupane will live to rue the day he impregnated a deaf and mute girl (15) as it has landed him in trouble and he will languish in jail for the next 12 years.
The accused, Believe Tshuma (35), appeared before Hwange magistrate Dambudzo Malunga for contravening section 65 of the Criminal Law Codification and (Reform Act) chapter 9:23 (rape). The circumstances are that between the period extending from 10 December to 18 December, the juvenile was left alone at her home.
It is said the accused got to the complainant's homestead and found her alone. He took advantage of the opportunity and forced the juvenile to lie down and raped her.
He had a pleasurable moment without the minors consent. However, his joy came to a halt when he was caught red-handed in the act by the minor's brother who is 12-years old.
The accused then threatened to kill the brother if ever he reported the matter, but still the brother out of innocence went ahead and told their grandmother on the same day, but the grandmother swept the matter under the carpet.
The matter came to light after months when the complainant started vomiting and was having a terrible headache. She was taken to hospital where a medical examination proved that she was pregnant.
Tshuma pleaded guilty to the charges saying he was prepared to marry the girl, but the magistrate had no sympathy for him and sentenced him to 12 years imprisonment.
