Man in court for bedding brother's wife

A BINGA man yesterday told a court he had complied with a local chief's order that he must give his brother two beasts in compensation for sleeping with his wife.

Justin Mwinde (35) of Siansali, Kariangwe village in Binga, was some time this year ordered by Chief Siansali to compensate his brother, Daimon, with two beasts and $100 after he was found guilty of being intimate with his sister in-law.

Justin only paid $50 and defaulted on paying the remainder.

This then prompted the brother to report the matter to the police, leading to his arrest.

Justin last month pleaded guilty to a contempt of court charge when he appeared before Binga resident magistrate Stephen Ndlovu.

The magistrate convicted him and ordered that he settle the payment before September 2, as had been ordered by the chief.

Yesterday Justin told the court that he had settled all the payments to his brother. However, Daimon was not in court.

Justin, supposed to be sentenced yesterday, had to be remanded to September 9.

The magistrate indicated the court needed to have the complainant confirming in court that he had received the payment from him.

Asked why he had slept with his brother's wife, Justin insisted that his brother's wife pestered him and he ended up falling for her seduction.

"She is the one who pestered me to do it," he said.

"She told me that my brother was weak in bed and she wanted me to have sex with her.

"I refused on several occasions, but I later gave in because she insisted."

The magistrate then advised him to be content with his own wife, rather than sleep with other people's wives.

Last month in his plea of guilty, Justin told the court that he did not have cattle to pay his brother, but had a scotch cart, which he tried to use to pay Daimon, who declined.
