Man bludgeons brother in law to death

A MAN who bludgeoned his brother-in-law to death with a log accusing him of having an affair with his wife has been sentenced to 12 years in prison.
Cephas Magagula (28), of Madala area of Nkayi, is beginning a 12-year jail stretch after pleading guilty to culpable homicide.
Bulawayo High Court judge Martin Makonese, on circuit in Hwange last week, handed down the sentence. Prosecuting, Miss Namatirai Ngwasha said Magagula "failed to control his emotions" after learning that Collet Sibanda (39) – who is married to his sister – was having a fling with his wife.
Magagula confronted Sibanda on 1 December, 2009, as he fetched firewood in the bush, the court heard. He picked up a log and hit Sibanda on the ribs and head and he collapsed.
He continued to rain blows on the hapless Sibanda until he was restrained by his brothers Fanisani and Thembani Magagula.
An unconscious Sibanda was carried home but died within minutes.
Before passing judgment, Justice Makonese said he considered that Magagula was a first offender who pleaded guilty and showed contrition.
