Woman asked nephew to watch as she raped his 15-year-old friend

A 29-year-old wife of an injiva stunned the court yesterday when she said she sexually abused her nephew's 15-year-old friend as a way of compensating for the absence of her husband who works in South Africa.

Sithembile Tshuma of Mabungwe area in Bulilima District invited the juvenile, a Form One pupil at Bezu Secondary into her bedroom where she slept with him in full view of her nephew.

Tshuma pleaded to be spared a jail sentence as she told the court that she had a two-year-old baby.

She said she was sexually starved as her husband who works in South Africa was often away.

Tshuma also said she was sexually attracted to the complainant who had also appeared attracted to her as well.

Prosecuting, Mr Paul Mpofu explained how Tshuma lured the complainant to spend the night at her home.

On 2 November at about 8pm the boy was at Tshuma's homestead playing with his friend.

As he was about to leave Tshuma called him to her bedroom and offered to accompany the juvenile to his home but he declined.

She then grabbed him by the hand and pushed the complainant onto her matrimonial bed and told him that she wanted to sleep with him.

Tshuma then had sex with the juvenile.

The boy started crying as he was feeling pain and this alerted his friend who found him and his aunt in the act.

Tshuma ordered his nephew not to intervene but to stand and watch in order to learn the process. The complainant reported the matter to his aunt the following morning.

Tshuma's nephew, Philisani Ndlovu said he heard his friend crying and he proceeded to the bedroom to find out what was happening.

"I found my aunt and my friend having sex but there were no indications of a struggle from my friend. My aunt ordered me to stand and watch without disturbing them.

"I did as I was told as I realised that my friend was consenting to the whole act," Philisani told the court.

Tshuma was convicted on her own plea of guilty by Plumtree magistrate Mr Gideon Ruvetsa.

She was sentenced to nine months imprisonment of which three months were suspended for five months on condition that she does not within that period commit an offence of the same nature.

The remaining six months were suspended on condition she performs 210 hours of community service at Bezu Primary School.
